Vic: Jack Thomas appeal application to be heard on today

A High Court application .. to prevent Melbourne man JACK THOMAS being re-tried on
terrorism charges .. will be heard today.

35-year-old THOMAS was cleared of terrorism charges in 2006.

But the Victorian Court of Appeal last month directed he be re-tried .. following statements
he made in an interview on ABC TV's Four Corners program.

THOMAS wasn't present at Monday's Supreme Court mention hearing .. which was scheduled
to determine the progress of the High Court application.

Justice ELIZABETH CURTAIN told the court a date for the new trial will be set once
the result of the application is known.
